Latest Appeals Case Update: Thank you, Skadden!

In January, Sylvia Tsakos from Skadden, Arps, Slate, Meagher & Flom LLP argued on behalf of DV LEAP and the Tennessee Coalition to End Domestic and Sexual Violence to help the TN appeals court understand the clear risks that parents who commit domestic violence pose to children and the specific red flags the father's actions raised in the case explained below.

This is a Tennessee case where the judge awarded the parties shared custody with the dad as a primary residential custodian despite dad's: admitted domestic violence against the mom; admitted use of corporal punishment ("whipping”), which both a therapist and GAL deemed harmful to these young children; and neglectful supervision resulting in their multiple injuries. In its ruling, the court violated TN's clear statute restricting visitation for a parent who has committed domestic violence and instead prioritized the equal division of parenting time over concerns about the children's safety and well-being.
